These Terms of Use govern your access to and use of the Breakout Models website and the submission of talent applications. By using our website, you agree to these terms. If you do not agree, please do not use our website.

1. Use of This Website

You may use this website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable local, national, or international law
• Attempt to gain unauthorized access to any part of the website or its underlying systems
• Use automated tools to scrape, crawl, or harvest content from this website without our written permission
• Transmit any unsolicited or unauthorized communications
• Post or transmit material that is defamatory, offensive, or otherwise objectionable

2. Talent Applications

Submitting an application through our Apply page does not create a contract, obligation, or guarantee of representation. Submission does not obligate Breakout Models to respond, review, or retain your application beyond the period described in our Privacy Policy.

By submitting an application, you confirm that:

• All information and photographs you submit are accurate and belong to you
• You have the right to share the content you are submitting
• You are not misrepresenting your identity, appearance, or measurements
• You understand that submission does not guarantee any response or next steps

Breakout Models does not charge any fees at any stage of the application or representation process. If you are ever asked to pay a fee to apply or to be considered for representation, you should not proceed and should report it to us.

3. No Employment Relationship

Use of this website and submission of an application does not create an employment relationship, agency agreement, or any contractual relationship between you and Breakout Models. Any formal representation agreement would be established through a separate written contract signed by both parties.

4. Intellectual Property

Our Content

All content on this website including text, design, graphics, logos, and layout is the property of Breakout Models or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this website without our express written permission.

Your Submissions

By submitting photographs, measurements, and other materials through our application form, you grant Breakout Models a perpetual, irrevocable, worldwide, royalty-free license to retain, store, and use those materials for any purpose related to our talent agency operations. This includes reviewing your application, maintaining internal records, presenting you to prospective clients if you are signed, and creating portfolio and promotional materials on your behalf.

You retain copyright ownership of your photographs. The license you grant us is to use those photographs, not to claim ownership of the underlying copyright. Where applicable law grants you statutory rights such as the right to erasure under GDPR, those rights are not affected by this license.

5. Photographs and Likeness Rights

Breakout Models will not use your photographs, likeness, or any biometric data for artificial intelligence training, machine learning, synthetic media generation, deepfake technology, or inclusion in any AI dataset without your explicit written consent and a separately negotiated agreement.

For represented talent, the specific terms governing the use of your image and likeness will be set out in your representation agreement.

6. Booking and Client Terms

Clients who engage Breakout Models to book talent agree that all bookings are subject to talent availability and mutual agreement. No booking is confirmed until a booking confirmation has been issued in writing by Breakout Models. All fees, usage rights, and terms specific to a booking will be set out in the applicable booking agreement.

Clients agree not to contact represented talent directly for the purpose of booking or soliciting work outside of Breakout Models. All inquiries regarding represented talent must go through the agency.

7. No Unsolicited Submissions

We only accept talent applications through our designated Apply page. We do not accept applications by email or through social media. Any unsolicited submission sent by any other method will not be reviewed and will be deleted.

8. Disclaimer of Warranties

This website is provided on an "as is" basis without warranties of any kind, express or implied. Breakout Models does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not make any representations regarding the suitability, accuracy, or completeness of any content on this website.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Breakout Models will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website, your application submission, or your reliance on any information on this website. Our total liability for any claim arising under these terms will not exceed one hundred dollars ($100).

10. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. Breakout Models has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

11. Privacy

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.
